DATA PROTECTION AND PRIVACY POLICY

At GOLMAR SISTEMAS DE COMUNICACIÓN S.A. we are committed to ensuring that your personal information is protected and not misused.

2.- SCOPE OF APPLICATION

This document is applicable to all processing of personal data, whether manual or automated, carried out through this website or other devices and forms belonging to GOLMAR SISTEMAS DE COMUNICACIÓN, S.A.

4.- FOR WHAT PURPOSE DO WE COLLECT YOUR PERSONAL INFORMATION?

The main reason we collect your personal information is to facilitate and improve the service that you as a customer/user expect from us.

We collect your personal information to process your purchases, orders or requests that you place with us, either through our website or apps, by telephone or on a paper form.

 

5.- TYPES OF PROCESSING

The different types of processing identified at GOLMAR SISTEMAS DE COMUNICACIÓN S.A. are listed below:

5.1. Customer Management:

1. Purpose of processing: management of the commercial relationship, administration and operation with customers, collection of products from our facilities (both in the Central at Cornellà, as in other GOLMAR sites).

2. Legitimacy of the treatment: the performance of a contract and/or legitimate interest.

3. Data collected: name, surname, ID card number, professional contact address, e-mail, NIF and signature.

5.2. HR and candidate management:

1. Purpose of processing: management of the employment relationship with employees, time and attendance control and candidates.

2. Legitimation of the processing: the performance of a contract.

3. Data collected: name, ID card number, social security number, address, e-mail address, telephone/mobile phone, marital status, date and place of birth, age, gender, nationality, bank account, profession, experience, training and skills.

5.3. Supplier Management:

1. Purpose of processing: management of the relationship with suppliers, collection of products from our facilities (both at the Cornellà headquarters and at other GOLMAR sites).

2. Legitimisation of the processing: performance of a contract and/or legitimate interest.

3. Data collected: name, surname, ID card number, professional contact address, e-mail, NIF, company name, bank account and signature.

5.4. Video surveillance and access control

1. Purpose of processing: to guarantee the security of persons, goods and facilities, compliance with emergency plans and the use of video surveillance as a means of company control of both access and the presence of workers in the workplace, as well as to verify compliance with their work obligations and duties.

2. Legitimisation of the processing: legitimate interest.

3. Data collected: name, surname, ID card number, telephone number, company and images.

5.5. Commercial promotions and communication with customers and potential customers

1. Purpose of processing: to inform about new products, promotional campaigns, opportunities, technological innovations, training on them and on products or services manufactured or represented by GOLMAR SISTEMAS DE COMUNICACIÓN S.A. and to send holiday greetings.

2. Legitimisation of the processing: consent of the interested party.

3. Data collected: ID card number / NIF, name and surname, telephone number and e-mail address.

 

6.- ORIGIN OF THE DATA

We collect personal information about you by different means, in some cases you will contact us to share your personal information (for example by sending an email), and in other cases we collect your personal information using other means.

We collect personal information that you provide to us through the GOLMAR SISTEMAS DE COMUNICACIÓN S.A. website, email, mobile phone, when you contract a service, when you fill out a form or others. For this reason, you undertake that the data provided to the data controller are current, real and true, and therefore, to inform the data controller of any update or modification of the same.

If you communicate personal data of a third party, you undertake to inform them in advance in accordance with the terms of articles 13 and 14 of the GDPR, to obtain their prior express written consent and to process the data for the purposes authorised by the third party.

7.- TO WHICH RECIPIENTS ARE YOUR DATA COMMUNICATED?

Your data will NOT be communicated for any purposes, whereby the data controller will not disclose personal data to third parties, unless there is a legal obligation or we have the express consent of the person concerned.

Specifically, personal data may be disclosed to:

1. Public Administrations, Judges and Courts for compliance with the legal obligations to which the data controller is subject due to its activity.

2. To financial institutions for compliance with the obligations arising from the contract between the data controller and the person concerned.

3. To third parties in all cases in which it is necessary for the development, fulfilment, execution and control of the contract between the controller and the data subject.

4. To data processors, access that in no case will imply a transfer of data, when it is necessary to access your personal data for the provision of the services that the data controller has contracted with these processors, and with whom they have signed a contract of treatment.

 

8.- HOW LONG DO WE STORE YOUR PERSONAL INFORMATION?

We only store your personal information to the extent we need to in order to use it based on the purpose for which it was collected, and based on the legal basis for processing it in accordance with applicable law.

Once the relationship has ended, the blocked information will be kept, without giving it any use, for the legally established periods that are necessary for the formulation, exercise or defence of possible claims and it will subsequently be deleted, unless there is a cause for retention.

 

9.- HOW CAN YOU EXERCISE YOUR RIGHTS?

Data protection regulations allow the data subject to exercise their rights of access, rectification, opposition, deletion, limitation of processing, portability, not to be subject to profiling or individualised decisions and to revoke the consent given without retroactive effect.

For this reason, we inform you that you may exercise your rights free of charge, by e-mail to rsgolmar@golmar.es attaching a copy of your ID card or equivalent supporting document.

The rights that you can exercise are:

  • Access: Consultation of personal data held by GOLMAR SISTEMAS DE COMUNICACIÓN S.A..
  • Rectification: Modification of your data if they have changed, are inaccurate or incomplete.
  • Deletion: Request to delete your data.
  • Opposition: Request for your data not to be processed.
  • Restriction of processing: Request to limit the processing of your data while:
    • The accuracy of the personal data is contested.
    • The processing is unlawful and the data subject opposes the erasure of the personal data.
    • GOLMAR SISTEMAS DE COMUNICACIÓN S.A. no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
    • Once a right of opposition has been requested, it is being verified whether this right prevails over a public or legitimate interest affecting the data subject of opposition until the resolution of the conflict.
  • Portability: right to receive the personal data concerning him or her, which he or she has provided to GOLMAR SISTEMAS DE COMUNICACIÓN S.A., in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller.

10.- HOW CAN I MAKE A CLAIM?

You can also, if you consider it appropriate, file a complaint with the Spanish Data Protection Agency (C/ Jorge Juan, nº6, 28001 - Madrid).

The claim may also be lodged with the competent body in the data subject's country of residence.

 

11.- MINORS

The contents of this website are intended for persons over 18 years of age, so that persons under 18 years of age may not access or provide us with personal data.

 

12.- MODIFICATIONS TO THE PRESENT DATA PROTECTION INFORMATION
